This Acceptable Use Policy ("AUP") governs your use of NakibVPS, LLC ("NakibVPS," "we," "us," or "our") services and is incorporated by reference into our Terms of Service. By using our services, you agree to comply with this AUP and all applicable laws and regulations.

NakibVPS reserves the right to modify this AUP at any time. Changes will be posted on our website, and your continued use of our services constitutes acceptance of any modifications. We encourage you to review this policy periodically.

1. General Principles

You may only use NakibVPS services for lawful purposes. We reserve the right to refuse service, suspend accounts, or remove any content that violates this AUP, with or without prior notice. Our services must not be used in any manner that could damage, disable, overburden, or impair our infrastructure or interfere with any other party's use of our services.

2. Prohibited Content

The following types of content are strictly prohibited on NakibVPS services:

2.1 Illegal Content

  • Content that violates any applicable local, state, national, or international law

  • Child sexual abuse material (CSAM) or any content exploiting minors

  • Content promoting terrorism, violence, or illegal activities

  • Sale or distribution of controlled substances without proper permits

  • Counterfeit goods or fraudulent services

2.2 Adult and Obscene Content

  • Pornographic or sexually explicit material

  • Escort services or dating sites with adult content

  • Obscene, defamatory, or excessively violent content

2.3 Gambling and Gaming

  • Online casinos, gambling platforms, or sports betting websites

  • Poker rooms or card games involving real money

  • Lottery, sweepstakes, or games of chance

  • Fantasy sports platforms with monetary prizes (unless properly licensed)

  • Gambling affiliate sites or casino review sites that facilitate gambling

2.4 Fraudulent and Deceptive Content

  • Phishing websites or pages designed to steal credentials

  • Scam websites, including advance-fee fraud schemes

  • High-yield investment programs (HYIP) or Ponzi schemes

  • Pyramid schemes or multi-level marketing with unrealistic promises

  • Payday loan sites with predatory practices

  • Fake reviews, testimonials, or deceptive marketing

2.5 Intellectual Property Violations

  • Unauthorized distribution of copyrighted material (software, media, etc.)

  • Warez sites, crack distribution, or piracy platforms

  • Unauthorized streaming of live sporting events or pay-per-view content

  • Trademark infringement or counterfeit brand websites

2.6 Other Prohibited Content

  • AutoSurf, PTC (Paid-to-Click), PTS, or PPC sites

  • Public image hosting scripts (without moderation)

  • Anonymous or bulk SMS gateways

  • Services selling social media followers, likes, views, or engagement

  • Essay mills or academic dishonesty services

3. Prohibited Activities

3.1 Network Security Violations

The following network-related activities are strictly prohibited:

  • Unauthorized scanning of external networks or IP addresses

  • Using fake, spoofed, or manipulated source IP addresses

  • Manually changing hardware (MAC) addresses

  • Port scanning, vulnerability scanning, or network reconnaissance

  • Packet sniffing or network traffic interception

  • Launching or participating in Distributed Denial of Service (DDoS) attacks

  • Exploiting security vulnerabilities in any system

  • Unauthorized access to systems, networks, or data

3.2 Cryptocurrency Activities

Cryptocurrency-related activities are prohibited on all NakibVPS services:

  • Cryptocurrency mining of any kind (Bitcoin, Ethereum, etc.)

  • Cryptocurrency farming or staking operations

  • Plotting for proof-of-space cryptocurrencies (Chia, etc.)

  • Operating mining pools or related infrastructure

  • Any application designed to generate or mine digital currencies

3.3 Anonymization and Proxy Services

  • Operating Tor exit nodes

  • Running open proxy servers intended for public abuse

  • Public VPN services designed to facilitate abuse or illegal activity

  • Anonymizer scripts or services

  • Cardsharing services (CCcam, OSCam, or equivalent)

3.4 Malicious Software and Hacking

  • Distribution of malware, viruses, trojans, or ransomware

  • Hosting or distributing exploit kits or hacking tools

  • Operating botnets or command-and-control (C2) servers

  • Brute-force attack tools or password cracking utilities

  • Mail bombing or flooding tools

  • Any tools designed to compromise system security

3.5 Abuse and Manipulation

  • Traffic exchange services (Hitleap, Jingling, etc.)

  • Black Hat SEO practices or techniques

  • Video game bots or automated gaming software

  • Click fraud or ad impression manipulation

  • Automated scraping that violates robots.txt or terms of service

  • IRC bots or scripts (on shared hosting)

4. Resource Usage Policy

4.1 Shared Hosting Restrictions

Shared hosting accounts are intended for active websites only. The following restrictions apply:

  • Using shared hosting accounts primarily for storage or backup is prohibited

  • The /home/ directory may not be used for storing backups beyond one cPanel backup

  • Running gaming servers on shared hosting is not permitted

  • Unattended server-side processes or daemons are prohibited

4.2 Excessive Resource Consumption

The following activities that cause excessive resource usage are prohibited:

  • Running web spiders, crawlers, or indexers at scale

  • BitTorrent clients or file-sharing/peer-to-peer applications

  • Running frequent or resource-intensive cron jobs

  • Long-running or unoptimized MySQL queries

  • Improper use of PHP include functions causing loops

  • Exceeding inode or storage limits

  • Any activity that degrades performance for other customers

4.3 Fair Use

We operate a Fair Use Policy to ensure optimal performance for all customers. If your usage significantly exceeds the average usage of other customers on similar plans, we may contact you to discuss an upgrade to a more appropriate plan or impose reasonable restrictions on your account.

5. Zero Tolerance Spam Policy

NakibVPS maintains a zero-tolerance policy against spam. For comprehensive details, please refer to our Anti-Spam Policy. In summary:

  • Sending unsolicited bulk emails is strictly prohibited

  • Accounts used for spamming may be terminated immediately without notice

  • Websites advertised via spam ("spamvertised") may not be hosted on our servers

  • Email address harvesting without consent is prohibited

  • Forging email headers or sender information is prohibited

6. Child Safety

NakibVPS has zero tolerance for any content that exploits, harms, or endangers children.

Any content harmful to minors, including but not limited to child sexual abuse material (CSAM), is strictly forbidden. Violations will be immediately reported to the National Center for Missing & Exploited Children (NCMEC), the Internet Watch Foundation (IWF), and appropriate law enforcement authorities. Accounts will be terminated immediately without refund.

7. Defamation Policy

NakibVPS does not arbitrate disputes regarding allegedly defamatory content. We do not remove content based solely on claims of defamation unless presented with a valid court order or legal judgment determining that the content is defamatory. We will comply with lawful court orders requiring content removal.

8. Copyright Infringement

We respect intellectual property rights and expect our customers to do the same. For information about reporting copyright infringement and our DMCA procedures, please refer to our Copyright Infringement Policy.

9. Policy Enforcement

9.1 Investigation Rights

NakibVPS reserves the right to investigate any suspected violation of this AUP. We may, at our sole discretion:

  • Suspend or terminate accounts without prior notice for serious violations

  • Remove or disable access to any content that violates this AUP

  • Cooperate with law enforcement investigations

  • Take legal action to protect our rights, property, or users

9.2 Consequences of Violations

Violations of this AUP may result in:

  1. Warning: Written notification requesting immediate corrective action

  2. Suspension: Temporary suspension of services pending resolution

  3. Termination: Permanent termination of services without refund

  4. Legal Action: Civil or criminal legal proceedings as appropriate

  5. Financial Liability: Charges for cleanup fees, blacklist removal, or damages incurred

9.3 Severity-Based Response

Serious violations — including but not limited to CSAM, DDoS attacks, malware distribution, or activities threatening our infrastructure — will result in immediate termination without warning or refund. Less severe violations may receive a warning with an opportunity to remedy the situation before further action is taken.

10. Disclaimer

While NakibVPS is not obligated to actively monitor customer activities, we may do so to ensure compliance with this AUP and to protect our infrastructure and other customers. We disclaim any responsibility for user-generated content and activities that violate this AUP. Customers are solely responsible for ensuring their use of our services complies with all applicable laws and this policy.

12. Acceptance

By using NakibVPS services, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.

This AUP should be read in conjunction with our Terms of Service, Privacy Policy, Anti-Spam Policy, and Copyright Infringement Policy.
