1. Our Commitment to Intellectual Property

NakibVPS is committed to complying with U.S. copyright law and responding promptly to clear notices of alleged copyright infringement. The company has registered a Designated Agent with the U.S. Copyright Office as required by the DMCA.

3. Filing a DMCA Takedown Notice

Copyright owners may submit a notification pursuant to the DMCA by providing the Designated Agent with required information in writing.

3.1 Required Elements of a DMCA Notice

A notification must include:

2. Identification of infringing material with specific URLs

3. Claimant's name, mailing address, telephone number, and email address

4. Statement of good faith belief that use is not authorized

5. Statement under penalty of perjury that information is accurate

3.3 Important Warnings

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

Submitters should consider whether the use qualifies as fair use before filing.

4. Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice, NakibVPS will:

1. Acknowledge receipt of the notice

2. Verify the notice contains all required elements

3. Remove or disable access to allegedly infringing material if valid

4. Notify the affected customer or user

5. Provide counter-notice information

Processing occurs within 24-48 business hours.

5. Filing a Counter-Notification

Customers may file a counter-notification if they believe material was removed by mistake or misidentification.

5.1 Required Elements of a Counter-Notification

A counter-notification must include:

1. Identification of removed material and its previous location with specific URLs

2. Your name, mailing address, telephone number, and email address

3. Statement consenting to jurisdiction of Federal District Court

4. Statement under penalty of perjury that removal resulted from mistake or misidentification

5. Physical or electronic signature

5.2 How to Submit Your Counter-Notification

6. Counter-Notification Process

Upon receiving a valid counter-notification, NakibVPS will:

1. Provide the original complainant with a copy of the counter-notification

2. Inform the complainant that material will be restored in 10-14 business days unless court action is filed

3. Restore the material if no court action is received within 10-14 business days

7. Repeat Infringer Policy

NakibVPS has adopted a policy of terminating accounts of users deemed to be repeat infringers in appropriate circumstances.

7.1 Definition of Repeat Infringer

A user may be considered a repeat infringer if they:

• Have been subject to more than two valid DMCA takedown notices

• Have had material removed more than twice for copyright infringement

• Have submitted counter-notifications determined to be invalid or made in bad faith

7.2 Consequences for Repeat Infringers

NakibVPS reserves the right to terminate any account at its sole discretion if it believes the user is infringing copyrights of others, regardless of the number of notices received.

8. Prohibited Infringing Activities

The following activities are strictly prohibited on NakibVPS services:

• Hosting, distributing, or linking to pirated software, movies, music, e-books, or other copyrighted content

• Operating torrent trackers or indexes for copyrighted content

• Hosting "warez" sites or file-sharing services for copyrighted material

• Streaming copyrighted content without authorization (movies, TV shows, sports events, etc.)

• Hosting IPTV services that distribute copyrighted broadcasts

• Operating "cyberlocker" or file hosting services used primarily for copyright infringement

• Hosting counterfeit goods or services that infringe trademarks

• Using automated tools to scrape or copy copyrighted content from other websites

• Operating cardsharing or satellite/cable descrambling services

• Hosting ROM sites, emulator downloads, or pirated video game content

Engaging in these activities may result in immediate account termination without notice or refund.

9. Safe Harbor Protection

NakibVPS qualifies for safe harbor protections under Section 512 of the DMCA as a service provider. The company:

• Does not have actual knowledge of infringing material unless properly notified

• Does not receive direct financial benefit from infringing activity where it has the right and ability to control such activity

• Responds expeditiously to remove or disable access to material upon receiving proper notification

• Has designated an agent to receive notifications and registered that agent with the U.S. Copyright Office

10. Trademark Infringement

While the DMCA addresses copyright infringement, NakibVPS also takes trademark infringement seriously. To report trademark infringement, contact abuse@nakibvps.com with:

• Description of trademark (word mark, logo, etc.)

• Trademark registration number and jurisdiction (if registered)

• Evidence of trademark rights

• Identification of allegedly infringing content with specific URLs

• Explanation of how the content infringes trademark rights

• Your contact information

The company will review complaints and take appropriate action, which may include removing content or suspending accounts.

11. Customer Responsibilities

As a NakibVPS customer, you are responsible for:

• Ensuring all content uploaded, hosted, or distributed does not infringe copyrights, trademarks, or other intellectual property rights

• Obtaining all necessary licenses, permissions, or authorizations for any copyrighted content

• Responding promptly to infringement notices

• Removing infringing content immediately upon becoming aware of infringement

• Indemnifying NakibVPS against any claims arising from your infringement of third-party intellectual property rights

12. Limitations

• NakibVPS cannot provide legal advice regarding copyright, fair use, or intellectual property matters

• The company is not responsible for determining validity of copyright claims and acts according to the DMCA upon receiving compliant notices

• Disputes between copyright owners and alleged infringers must be resolved through the legal system

• This policy applies only to content hosted on NakibVPS services; the company cannot act on content hosted by third parties

13. Policy Changes

NakibVPS reserves the right to modify this Copyright Infringement Policy at any time. Changes are effective immediately upon posting to the website. The "Last Updated" date will be modified when changes are made. Continued use of services after modification constitutes acceptance of the updated policy.
