Anti-Spam Policy
1. Definition of Spam
For the purposes of this policy, "spam" includes, but is not limited to:
Unsolicited Bulk Email (UBE): Any email message sent to multiple recipients who have not explicitly requested or consented to receive such communications
Unsolicited Commercial Email (UCE): Commercial advertising or promotional messages sent without the recipient's prior consent
Email with Forged Headers: Messages with falsified sender information, routing data, or other header manipulation
Deceptive Email: Messages with misleading subject lines, false sender identities, or fraudulent content
Email Harvesting Results: Messages sent to addresses collected through automated harvesting, scraping, or purchasing of email lists
2. Prohibited Activities
The following activities are strictly prohibited when using NakibVPS services:
2.1 Email-Related Prohibitions
Sending unsolicited bulk or commercial email of any kind
Sending chain letters, pyramid schemes, or Ponzi scheme solicitations
Sending emails with forged, falsified, or manipulated headers
Using deceptive subject lines or misleading sender information
Sending emails that do not include a valid physical mailing address
Sending emails without a clear and functional unsubscribe mechanism
Failing to honor unsubscribe requests within 10 business days
Operating open mail relays or open proxy servers
Using our services to relay email through third-party servers without authorization
2.2 List and Address Prohibitions
Harvesting, scraping, or collecting email addresses from websites, directories, or other sources without consent
Purchasing, selling, or renting email lists from any source
Using third-party email lists, even if claimed to be "opt-in"
Adding email addresses to mailing lists without explicit, verifiable consent
Using software designed to harvest email addresses or generate random addresses
Operating as a list broker or email list rental service
2.3 Technical Prohibitions
Configuring mail servers to accept and relay email from unknown third parties
Using scripts or software to send bulk email without proper throttling and authentication
Sending email through compromised or hijacked systems
Participating in botnets or using botnet-controlled systems for email delivery
Circumventing spam filters, blacklists, or other anti-spam measures
Using our IP addresses to send email that results in blacklisting
3. Prohibited Content Types
Emails sent through NakibVPS services must not contain or promote content related to the following categories, regardless of whether the recipient has opted in:
3.1 Adult and Dating Content
Pornographic or sexually explicit material
Adult novelty items or products
Dating, matchmaking, or escort services
Adult entertainment services
3.2 Financial and Marketing Schemes
Multi-level marketing (MLM) or network marketing
Affiliate marketing or CPA marketing campaigns
Get-rich-quick schemes or "make money fast" offers
Online trading, forex, or stock market promotions
Credit repair or debt consolidation services
Mortgages, loans, or financial services (without prior written approval)
Cryptocurrency investment schemes or ICO promotions
3.3 Gambling and Gaming
Online gambling or casino services
Sports betting platforms
Online sweepstakes or lottery services
Gambling-related products or services
3.4 Fraudulent and Deceptive Content
Phishing emails or fake security alerts
Counterfeit or replica designer goods
Fake pharmaceuticals or unapproved medications
Social engineering or impersonation attempts
Selling social media followers, likes, views, or engagement
Essay writing or academic fraud services
3.5 Other Prohibited Categories
Herbal highs, synthetic drugs, or incense products
Unapproved nutritional supplements or weight loss products
Unlicensed streaming TV or pirated content services
Lead generation or selling leads (without prior written approval)
Bulk RFQ (Request for Quote) emails
External email-to-SMS services exceeding 100 messages per month
Keyloggers, spyware, or surveillance software
4. Email Best Practices Requirements
All customers sending email through NakibVPS services must adhere to the following best practices:
4.1 Consent Requirements
Explicit Opt-In: Recipients must have explicitly requested to receive emails from you
Double Opt-In (Recommended): Use confirmed opt-in (double opt-in) for all mailing lists
Consent Records: Maintain records of when and how consent was obtained for at least 3 years
No Pre-Checked Boxes: Do not use pre-checked consent boxes on signup forms
Clear Purpose: Clearly explain what emails subscribers will receive at the time of signup
4.2 Email Content Requirements
Accurate Headers: All email headers must be accurate and not misleading
Clear Identification: Clearly identify yourself or your business as the sender
Honest Subject Lines: Subject lines must accurately reflect the content of the email
Physical Address: Include a valid physical mailing address in every commercial email
Unsubscribe Link: Include a clear, conspicuous, and functional unsubscribe mechanism
Honor Opt-Outs: Process unsubscribe requests within 10 business days
4.3 Technical Requirements
SPF Records: Configure proper SPF records for all sending domains
DKIM Signing: Implement DKIM signing for email authentication
DMARC Policy: Establish a DMARC policy for your domains
rDNS/PTR Records: Ensure proper reverse DNS is configured for sending IPs
List Hygiene: Regularly clean your mailing lists to remove invalid addresses and bounces
Bounce Handling: Implement proper bounce handling and remove hard bounces immediately
Rate Limiting: Send emails at reasonable rates to avoid triggering spam filters
5. Sending Limits
To maintain the integrity of our email infrastructure and protect all customers, the following sending limits apply:

Customers requiring higher sending limits must contact us in advance for approval. Mass marketing emails should be sent through dedicated email marketing platforms (such as Mailchimp, SendGrid, or similar services) rather than through our hosting infrastructure.
6. Our Enforcement Measures
NakibVPS takes proactive measures to prevent spam and protect our network reputation:
6.1 Monitoring and Detection
Automated systems monitor email traffic patterns for signs of abuse
Rate limiting is enforced to prevent bulk sending without authorization
Outbound email is scanned for known spam signatures and malware
We monitor major blacklists and take action when our IPs are listed
Feedback loops are established with major email providers
6.2 Complaint Handling
All spam complaints are investigated within 24 hours
We participate in feedback loops with major ISPs and email providers
Complaints received through abuse@nakibvps.com are prioritized
Pattern analysis is performed to identify repeat offenders
6.3 Legal Compliance
We comply with all applicable anti-spam laws and regulations, including:
CAN-SPAM Act (United States)
CASL – Canada's Anti-Spam Legislation
GDPR – General Data Protection Regulation (European Union)
PECR – Privacy and Electronic Communications Regulations (United Kingdom)
Other applicable international anti-spam laws
7. Consequences of Violations
Violations of this Anti-Spam Policy will result in enforcement action based on the severity and frequency of the violation:
7.1 First Violation (Minor)
Written warning via email
Requirement to take immediate corrective action
Temporary suspension of email sending privileges
Documentation of the incident
7.2 Second Violation or Serious First Offense
Immediate suspension of email services
Full account suspension pending investigation
Requirement to provide proof of consent for all mailing lists
Administrative fee of up to $250 may be assessed
7.3 Third Violation or Severe Offense
Immediate account termination without refund
Permanent ban from NakibVPS services
Reporting to relevant authorities and blacklist operators
Legal action to recover damages and costs
7.4 Zero-Tolerance Offenses
The following offenses result in immediate termination without warning:
Sending phishing emails or participating in fraud
Operating botnets or using compromised systems
Intentionally causing our IP addresses to be blacklisted
Sending malware, viruses, or other malicious content
Any spam activity that causes significant harm to our network or other customers
8. Reporting Spam
If you have received spam from a NakibVPS customer, please report it to us immediately. We take all reports seriously and will investigate promptly.
8.1 How to Report

8.2 What to Include
Please include the following information in your report:
Full email headers (required for investigation)
The complete body of the spam message
Any URLs or links contained in the message
The date and time you received the message
Your email address that received the spam
Any additional context that may be helpful
8.3 Response Time
We aim to acknowledge all spam reports within 24 hours and complete investigations within 72 hours. For urgent matters involving phishing or malware, please indicate "URGENT" in your subject line.
9. Customer Responsibilities
As a NakibVPS customer, you are responsible for:
Ensuring all email sent through our services complies with this policy
Maintaining proper consent records for all recipients
Securing your accounts, websites, and applications against compromise
Monitoring your own email sending for signs of abuse
Immediately reporting any suspected compromise of your account
Ensuring any third parties using your services comply with this policy
Educating your own customers and end users about anti-spam requirements (for resellers)
10. Reseller Responsibilities
Resellers of NakibVPS services have additional responsibilities:
Implement and enforce an anti-spam policy at least as strict as this policy
Communicate anti-spam requirements to all end customers
Take immediate action when notified of spam from their customers
Maintain abuse contact information and respond within 24 hours
Accept responsibility for the actions of their end customers
11. Policy Changes
NakibVPS reserves the right to modify this Anti-Spam Policy at any time. Changes will be effective immediately upon posting to our website. We will notify customers of significant changes via email. Your continued use of our services after any modification constitutes acceptance of the updated policy.
